Addresses the Independent, Non-coordinated Excepted Benefits Coverage
portion of Tri-Agency Rule (89 Fed. Reg. FR 23338-01). The Colorado Division of Insurance expects all carriers offering limited benefit fixed indemnity plans to make all necessary changes to comply with the required federal changes. The bulletin includes filing requirements, and a Colorado-specific Fixed Indemnity Notice to be displayed before the Federal Notice.

Provides guidance as a result of the U.S. District Court of the Eastern District of Texas setting aside and vacating the provisions of the federal Tri-Agency rule relating to the notice requirement for fixed indemnity insurance. If a carrier chooses not to provide the Federal Notice, the carrier must comply with the notice requirements of 14 VAC 5-141-30 A and 14 VAC 5-141-120 B 6. For carriers that choose to provide the Federal Notice, the Department will continue to waive the requirements of 14 VAC 5-141-30 A and 14 VAC 5-141-120 B 6.
